Terms of Service

These terms govern use of Zallant™, a lead follow-up service for real estate teams operated by NSU Systems LLC ("Zallant", "we", "us"). By creating an account or using the service, you agree to these terms. If you use Zallant for a team or company, you agree on its behalf.

The service

Zallant captures leads from web forms and open-house sign-ins, alerts the assigned agent, sends replies and follow-ups that leads agreed to receive, and can send leads to a customer's CRM, such as Follow Up Boss. Features may change as we improve the service.

Accounts

• Keep your sign-in email secure. Sign-in links are personal; don't share them.
• Team leads are responsible for who they invite and for removing people who leave.
• You're responsible for activity under your team's account.

Your responsibilities

• Consent: only add contacts who agreed to be contacted, and only send messages they agreed to receive. Use Zallant's consent checkboxes; don't mark consent you didn't receive.
• Laws: comply with applicable laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM, state telemarketing and privacy laws, and fair housing laws. Don't use lead information, including any military or veteran status, to discriminate.
• Content: you're responsible for the message templates you edit and the content your team sends.
• Acceptable use: no spam, purchased or rented contact lists, misleading messages, or unlawful content, and no attempts to break or misuse the service.

SMS program terms

Program: Zallant sends text messages on behalf of real estate teams to people who asked to be contacted about a property or real estate inquiry. Messages include a reply from the assigned agent, follow-up check-ins, and responses to your replies. Agents on a customer's team also receive lead alerts by text.

How you opt in: you opt in by checking an unchecked box on a team's web form or open-house sign-in page that says you agree to receive text messages from that team about your inquiry, and then submitting the form. Consent is not a condition of purchase.

• Message frequency varies, typically up to 4 messages per inquiry plus replies to your messages.
• Message and data rates may apply.
• To stop: reply STOP (or UNSUBSCRIBE, CANCEL, END, QUIT) at any time. You'll get one confirmation and no further texts from that team's number. Reply START to opt back in.
• For help: reply HELP, or email neeraj@zallant.com.
• Carriers are not liable for delayed or undelivered messages.
• We don't send automated texts between 9pm and 8am in the team's local time.

Fees

Pilots are free for the agreed period. Paid plans, if any, will be agreed in writing or shown at sign-up before you're charged.

Your data

Your team owns its lead data. You give us permission to process it to provide the service, as described in our Privacy Policy. You can export your leads at any time (CSV).

Third-party services

Integrations such as Follow Up Boss, text messaging carriers and email providers are run by third parties. We're not responsible for their availability or for how they handle data under their own terms.

Disclaimers and limitation of liability

The service is provided "as is." We work to keep it reliable, but we don't guarantee it will be uninterrupted or error-free, or that every message will be delivered. To the extent permitted by law, Zallant is not liable for indirect, incidental or consequential damages, or for lost profits or deals. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim (or $100 if you paid nothing).

Ending use

You can stop using Zallant at any time. We may suspend accounts that violate these terms or put messaging compliance at risk. On request, we'll delete your team's data after you close your account, except records we must keep by law.

Governing law

These terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules.
